Terms and Conditions

These terms apply when you use marktopley.co.uk, the Mark Topley ETP app, or buy any product, course or service from us. "We", "us" and "our" mean Purpose Driven Business Limited, trading as Exceptional Team Performance, a company registered in England and Wales (company number 13248875), registered office The Charmwood Centre, Southampton Road, Bartley, Southampton, SO40 2NA. By using the website or app, or buying from us, you agree to these terms and to our Privacy Policy.

1. The website and app

The website and app give you access to information about our work and, if you have an account, to your courses, roadmaps, resources and community. We work to keep them available and secure, but we can't promise they will always be uninterrupted or error-free. We may update, change or withdraw features, content or the app itself as our programmes develop.

2. Your account

Some parts of the website and app need an account. Please keep your login details private and let us know straight away if you think someone else has used your account. You're responsible for activity on your account. Accounts are for the named person only, so please don't share them with colleagues. If your practice needs access for more people, get in touch and we'll set them up.

We may suspend or close an account that breaks these terms, or when your programme or purchase ends. You can ask us to delete your account at any time (see the Privacy Policy).

3. Using our content

Everything on the website and in the app, including courses, videos, templates, toolkits, roadmaps and workbooks, belongs to Purpose Driven Business Limited. You may use it within your own practice and with your own team. You may not copy, resell, republish or share it outside your practice, or use it to train other people commercially, without our written permission.

4. Community and things you post

If you post in a community space or comment in the app, please be respectful, keep patient and team confidentiality, and don't post anything unlawful, offensive or promotional. You keep ownership of what you post, and you give us permission to display it within the community. We may remove posts or restrict access where these standards aren't met.

5. Prices and payment

Prices are shown in pounds sterling (£) and include VAT unless stated otherwise. Payment is due in full at purchase unless a payment plan or subscription is agreed. Where payment fails or is reversed, we may pause access until it's resolved.

6. Courses and digital products

Digital products and on-demand courses are licensed to you for your learning and use within your practice. "Lifetime access" means for the life of the product, not your lifetime. We may update or improve content over time.

7. Coaching and live sessions

Where coaching, group calls or in-practice sessions are included, the specific schedule and commitments are set out in your agreement or proposal, and those terms take priority over this page where they differ. Please give at least 24 hours' notice to move a session. Missed sessions without notice may not be rearranged.

8. Refunds and cancellations

We offer a 30-day money-back guarantee on most digital products and coaching programmes. To request a refund, email [email protected] within 30 days of purchase. After that, refunds aren't available unless required by the Consumer Rights Act 2015 or set out in your agreement.

Subscriptions can be cancelled at any time unless a minimum commitment is stated at purchase or in your agreement. Access ends at the close of your final billing period.

9. Our responsibility to you

Our work is educational and advisory. It isn't legal, financial, clinical, HR or medical advice, and results depend on how it's put into practice, so we can't guarantee specific outcomes. We're not responsible for losses that weren't foreseeable, for business losses such as lost profit, or for problems caused by things outside our reasonable control. Where we are liable, our total liability is limited to the amount you paid us for the product or service concerned. Nothing in these terms limits liability that can't be limited by law, including for death or personal injury caused by negligence, or for fraud.

10. Changes to these terms

We may update these terms from time to time. The version on this page on the day you use the website or app is the one that applies. If a change significantly affects an active programme, we'll let you know.

11. Law and disputes

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland, Northern Ireland or Ireland, you may also be able to bring proceedings in your local courts. If something goes wrong, please talk to us first, and we'll do our best to put it right.
